Terms & Conditions for the usage of XOX MOBILE operator services and products

MANJASIM TERMS AND CONDITIONS

 

General

1.    The ManjaSIM Plan (“Plan”) is made available by XOX Digital Sdn Bhd (“XOX”) to you, the Subscriber, signing up for the Plan. The Plan offered is under the ManjaSIM brand by HI Mobility Sdn Bhd ("HI"), in collaboration with XOX.

 

2.    These terms and conditions (“Terms and Conditions”) contain important information that governs the subscriber’s use of the Plan and data usage and data speed to the Internet (“Service”). Upon subscription to the Plan, you are deemed to have read, unconditionally accepted, and be bound by these Terms and Conditions as may be amended from time to time.

 

3.     The ManjaSIM Plan and Service are subject to the General and Specific Terms and Conditions governing the use of XOX’s Products and Services, ONE-X Prepaid Terms and Conditions, XOX Fair Usage Policy and any other applicable terms and conditions, all at ONEXOX’s official website at https://onexox.my/tanc/details.

 

4.    XOX reserves the rights without liability to revise these Terms and Conditions, Plan and pricing. Where reasonably practicable, XOX will provide you prior notice of such changes. Once such changes have been made, all previous versions of XOX Subscriber guides or leaflets shall be superseded. You accept the responsibility to regularly review information on the Plan and Services and XOX website, including changes to these Terms and Conditions. Your continued use of the Plan and/or Service after the effective date of any revisions/changes to the Terms and Conditions, shall constitute unconditional acceptance of such revisions/changes and therefore you shall be bound by the same. If you do not accept such revisions/changes, you may terminate and/or discontinue using the Plan and/or Service, failing which you shall be assumed to have accepted the changes.

5.    The Services available for subscription under the Plan are as follows:

 

 

6.    The Plan commences on the date of successful activation of the Plan (“Activation”).

 

7.    The unlimited Talk Time allocated under the Plan only applies to standard person to person domestic mobile ON-net usage (XOX to XOX calls); excluding OFF-net usage (calls from XOX to other service provider), calls to fixed lines, video calls, calls to numbers with special charges or calls to toll-free numbers.

 

8.    By using the Services, you acknowledge and agree that XOX may, at its’ absolute discretion, limit the browsing speed and the quality of video streaming, should your data usage exceed the allocated data quota.

 

9.    Upon depletion of the allocated Talk Time quota, or in the event SMS is utilised, the following rates shall apply:

 

 

10.  XOX does not guarantee or warrant the availability of the data usage, and you acknowledge and agree that the data usage is provided on an "as is" basis.

 

11.  XOX reserves the right to alter, modify, change, suspend, restrict and/or discontinue the Plan or any part thereof, at any time, as deemed necessary, at its sole discretion. These actions may be taken without prior notice to you and XOX shall at all times be indemnified of any and all liability for any loss or inconvenience to you resulting therefrom.

 

Eligibility

12.  On your application to us for the Plan, you agree and consent for XOX to verify your information in order to determine, at our discretion if the Service may be made available to you. In the event the Service cannot be supplied, your application (including your personal details) will be kept in our records pending availability of the same. Please refer to XOX’s Privacy Statement at https://onexox.my/privacyStatement/details for more information. Notwithstanding, we reserve the right to change the eligibility criteria at any time and from time to time.

 

13.  The Plan is available to all via new registration only.

 

14.  You confirm that you are above the minimum age of twelve (12) years, and have read, understood, and accepted the Terms and Conditions stated herein.

 

15.  For non-Malaysians to be eligible, you must possess a valid passport with a remaining validity period of no less than six (6) months at the time of registration.

 

Registration

 

16.  You are strictly limited to registering up to five (5) SIMs under a single National Registration Identity Card (NRIC) or passport.

 

17.  Malaysian citizen is required to use a valid NRIC only to register, whereas non-Malaysian is required to use a valid passport only to register.

 

18.  You may subscribe to the Plan through the official ManjaSIM’s website and/or platforms.

 

Auto-Renewal

 

19.  Auto-renewal occurs when your Plan automatically renews at the end of your Plan’s initial expiry period.

 

20.  Your Plan will be auto renewed provided that you have sufficient prepaid credit (“Airtime”) in your Account. For avoidance of doubt, “Account” refers to your registered account under the Plan.

 

21.  To disable auto renewal, you may send “DATA AR OFF” to 23388/22111.

 

22.  To terminate the Plan immediately, you may send “DATA END” to 23388/22111.

 

Top-Up

 

23.  A top-up of RM1.00 is equivalent to RM1.00 Airtime with ONE (1) day of Prepaid Validity under the Subscriber’s Account. Non-Malaysian Subscribers will be subjected to 6% SST.

 

24.  Prepaid Validity refers to the period during which an Account remains active.

 

25.  If your Account is barred, you must top up a minimum amount of RM5.00 to reactivate your Account.

 

26.  Airtime transfers will extend the recipient’s Prepaid Validity. The Prepaid Validity period will correspond to the specified Prepaid Validity rates listed as follows:

 

Personal Data

27.  By registering and subscribing to the Plan, you consent to the collection, use, and disclosure of your Personal Data in accordance with the Personal Data Protection Act (2010) of Malaysia (the “PDPA 2010”) (As Amended) and our Privacy Notice (as detailed out in https://xox.com.my/privacyStatement/details/). “Personal Data” means name, address or email address, and includes less obvious data such as device-related data, call records, online identifiers, location data, and account activity.

 

28.  Your Personal Data may be used for the purposes of:-

i.        To provide and maintain our Services which you subscribed to;

ii.       For pre-contractual enquiry before you subscribe to any of our Services;

iii.       To process your transactions and manage your Account;

iv.      To communicate with you regarding your Account, including billing and Service updates;

v.       For compliance with legal obligations;

vi.      For marketing purposes, where you have given consent.

29.  We may disclose your personal data to:

i.        Third-party service providers engaged to assist us in delivering our services.

ii.       Regulatory bodies or authorities as required by law.

iii.       Other parties as consented by you.

30.  You have the right to access and correct your Personal Data at any point of time, as well as to withdraw consent for the processing of your Personal Data. For any inquiries or requests, please contact our customer service.

 

31.  XOX reserve the right to update the terms herein and/or our Privacy Notice periodically to reflect changes in our business, legal, regulatory requirements, and applicable laws. You shall be responsible to visit our Privacy Notice regularly to stay informed about any modifications.

 

32.  If we choose to use or disclose your personally identifiable information in a manner that significantly differs from what was stated in our Privacy Notice at the time of collection, we will provide you with options regarding the new use or disclosure including giving you the opportunity to opt out.

 

Data Sharing Consent

33.  By opting into such Promotions, you expressly consent to the sharing of your personal data (limited to name, identity no., mobile number, and subscription status) with the relevant Third Party for the purposes of:

(i)    Eligibility verification;

(ii)   Offer fulfilment;

(iii)  Campaign performance tracking; and

(iv)  Reporting to CTOS Data Systems Sdn Bhd (Company No.: 199001009139 (209029-W)) (“CTOS”) or other licensed credit reporting agencies for:

·      Conducting credit checks and trade reference assessments to evaluate your creditworthiness for the Plan;

·      Updating and maintaining credit information related to your account;

·      Reporting any payment defaults, fraud, or breaches which may result in your account being flagged on CTOS’s credit blacklist.

in accordance with XOX’s Privacy Notice and the Personal Data Protection Act 2010.

 

Miscellaneous

34.  By your subscription to the Plan, you are deemed to have read, understood, and agreed to be bound by these Terms and Conditions and agree that any and all decisions made by XOX in relation to every aspect of the Service shall be final, binding and conclusive.

 

35.  Any breach of these Terms and Conditions may, at XOX’s absolute discretion, result in forfeiture of any of the goods or services rendered. XOX shall not be liable for any claim whatsoever resulting from your use of the Service.

 

36.  XOX does not warrant that the Service shall be uninterruptible and/or error free. By using the Service, you hereby acknowledge and irrevocably agree that XOX shall not in any manner whatsoever be liable for any technical failures of any kind, system/server interruption and/or any electronic error arising from the Service unless the same arise from and are caused directly by XOX’s gross negligence and wilful default.

 

37.  XOX is not liable for any default in respect of the Service due to any circumstances beyond XOX’s control including but not limited to acts of God, acts or omissions of government or other authorities, new or amending Laws and regulations effective after the date of this Agreement, acts of terrorisms/sabotage, fires, explosions, lockouts, restrictive movements, riots, strikes, embargoes, act of war, epidemics, pandemics, inclement weather, earthquakes and other natural disasters.

 

38.  XOX reserves the right to change, amend, modify, suspend, continue, vary, modify terminate, and/or add on to all or any part of the Terms & Conditions at any time without prior notice. The Terms and Conditions stated herein shall continue to apply subject to any changes, amendments, modifications, suspensions, continuations, variations, modifications, terminations and/or additions contained in this document and shall be read and construed to be enforceable as if such changes, amendments, modifications, suspensions, continuations, variations, modifications, terminations and/or additions were inserted in the document.

 

39.  XOX, its related and associated companies, and its agencies and companies associated with the Service disclaim all warranties, express or implied, including but not limited to any implied warranties of merchantability or fitness for a particular purpose. XOX shall not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death, which is suffered or sustained (Whether or not arising from any person’s negligence) resulting from their use of the Service, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). You undertake that you shall not bring any claims or actions against XOX or its related and associated companies, whether in contract, tort or otherwise.

 

40.  By your use of the Service, you irrevocably agree to release and hold harmless XOX and its associate companies, employees, advisors for any and all losses, damages, rights, claims and actions of any kind in connection with the Service, including without limitation, personal injury, death, and property damage.

 

41.  Failure by XOX to insist upon or enforce strict performance of any of these Terms and Conditions shall not be construed as a waiver of any provision or right.

 

42.  These Terms and Conditions are governed by the laws of Malaysia. You agree that the Courts of Malaysia have exclusive jurisdiction over all matters arising from this Service.
