Terms & Conditions for the usage of XOX MOBILE operator services and products
XOX PHONE BUNDLING PLANS TERMS & CONDITIONS
1. These terms and conditions (“Terms and Conditions”) are to be read together with the General Terms and Conditions, General and Specific BLACK Terms and Conditions, Data Buffet Plans Terms and Conditions, FC Plans Terms and Conditions, and any other applicable policies governing the Subscriber’s use of the Services.
2. Upon registration and activation of any of the XOX Phone Bundling Plans, Subscribers shall be deemed to have acknowledged, read, unconditionally accepted, and agreed to be bound by these Terms and Conditions.
3. XOX MOBILE reserves the absolute right to rescind any of the privileges accorded to the Subscriber under the Plans or part thereof in the event the registered service is not in accordance with the stipulated eligibility criteria, or is not used in accordance with the Agreement, Plans, or if XOX MOBILE suspects any illegal usage or fraud including but not limited to the Service, or part thereof, including but not limiting to selling or reselling of the Services or part thereof without written consent by XOX MOBILE.
ELIGIBILITY
4. On your application to us for the Service, you agree for us to verify your information in order to determine, at our discretion if the Service may be made available to you. In the event the Services cannot be supplied, your application (including your personal details) will be kept in our records pending availability of the same. Please refer to our Privacy Statement on XOX Official Website for more information.
5. In order to be eligible, the Subscriber confirms that he/she is a Malaysian citizen above the minimum age of eighteen (18) years, have read, understood and accepted the terms and conditions stated herein. For Subscribers who are below the legal age of eighteen (18) years, parental consent is required before subscribing to any XOX Phone Bundling Plans.
6. The Terms and Conditions stated herein shall be applicable for all Plans and Promotions as offered or may be offered by XOX MOBILE to Subscribers as part of the Services. The Terms and Conditions shall be in force immediately from the date of acceptance by the Subscriber (which is defined by the availability of the Service and usage by the Subscriber). The Subscribers shall refer to the Plans available for registration offered under each Plan.
REGISTRATION
7. XOX Phone Bundling Plans consist of B89DB and TBG150. Subscribers may refer to the Terms and Conditions for the respective BLACK Plans for more information.
8. The Subscriber may register for any of the XOX Phone Bundling Plans at participating XOX Authorized Physical Outlets as stated below:
a. SPACE Sunway Pyramid
b. SPACE Sunway Velocity
c. XCC Queensbay
d. XCC ICT Komtar
e. XCC Kuching
f. XPP IOI Putrajaya
g. XPP Ipoh Parade
h. XPP Paradigm Mall, Kelana Jaya
i. XPP Aeon Bandaraya Melaka
j. XPP Giant Kuantan
k. XPP Aeon Kota Bharu
l. XPP AU2
*Additional outlets will be updated from time to time. The devices are subject to the availability at each outlet.
9. The Subscriber agrees to pay XOX MOBILE at the point of registration, a sum as Advance Payment equivalent to the Plan subscribed, the Device Upfront Payment as stipulated according to the Plan subscribed, and the Full Device Price.
Payment upon Registration: Device Offer Price + Advance Payment + Upfront Device Payment

10. The Subscriber further agrees that no interest shall be paid by XOX MOBILE for the Advance Payment made and the Advance Payment made shall be used to contra with the first month usage Charges due and payable by the Subscriber to XOX MOBILE.
MOBILE NUMBER PORTABILITY (MNP)
11. Mobile Number Portability (“MNP”) is the ability for an end-user to change from one Public Cellular Service provider to another Public Cellular Service Provider whilst retaining the said mobile number.
12. You are able to switch from your mobile service provider to XOX MOBILE while retaining your existing mobile number. In doing so, you confirm and agree that:
a. The Mobile Number Portability request may be subject to a non-refundable porting fee in any event whatsoever;
b. The mobile number requested must be in the range of mobile numbers approved by MCMC from time to time;
c. You must provide valid identifications including, but not limited to MyKad, Armed Forces Identification Card and/or passport, Company Registration documents;
d. Only active mobile number at the time of the request is eligible for porting to ONEXOX BLACK. Mobile Number which has been suspended, terminated, blacklisted on XOX MOBILE database and/or barred will not be eligible for Porting;
e. MNP is subject to existing geographic numbering requirements;
f. You are allowed to port from prepaid to postpaid/ONEXOX BLACK Service(s) and vice versa;
g. Upon request, you must provide all other information as required from XOX; and
h. You agree and accept that all Porting requests are subject to XOX terms and conditions for new registration.
13. Subscribers may port-in to ONEXOX BLACK via the following channels: -
a. XOX Online Store;
b. At any Official XOX Service Centres; or
c. Through an authorised BLACK Dealer.
14. The Advance Payment of the selected Plan must be made in order to activate the SIM Card. Advance Payment will be used to offset the first month’s fee and is non-refundable.
15. XOX MOBILE shall not be responsible and/or liable to you or any person claiming through you for the following: -
a. For any period of outage during the Subscribers’ Service(s) or any related ancillary Service(s);
b. For any damage, loss, costs or expenses or other liability in contract or tort or otherwise direct or indirect relation thereto; and/or
c. For any interruption and/or delay in approving and/or unsuccessful Port into XOX.
16. In the event that the Subscribers’ Port-In request to XOX MOBILE is still pending from the DNO, Subscriber is not allowed to register for the XOX Phone Bundling Plans.
17. Subscribers are only allowed to register for the XOX Phone Bundling Plans upon successful Port-In to XOX MOBILE.
CHARGES AND DEVICE UPFRONT PAYMENT
18. The availability, charges, and upfront payment of the Devices under this Plan depends on the participating XOX Authorized Physical Outlets as stated in Clause 8.
19. The Subscriber may refer to the appendix of these Terms & Conditions for the list of upfront payment of the Devices available under the XOX Phone Bundling Plans.
20. The Device Upfront Payment is payable by Subscriber to XOX MOBILE as part of the purchase price of the Device. The Device Upfront Payment is not the Advance Payment, which is a separate payment.
21. The Device Upfront Payment is rebated over the 24 Months Contract with XOX MOBILE.
22. The Subscriber is hereby solely responsible for the payment of all charges associated with the XOX Phone Bundling Plans.
DEPOSIT AND ADVANCE PAYMENT
23. No deposit is required to register for the XOX Phone Bundling Plans.
24. The Advance Payment is payable by Subscriber to XOX MOBILE, which will be used to contra with the first month usage charges due.
25. The Advance Payment is equivalent to ONE (1) month of the monthly commitment fee of the Plan subscribed.
COMMITMENT PERIOD AND EARLY TERMINATION
26. The commitment period of the Plan available for the Subscriber is TWENTY-FOUR (24) months commencing from the date of registration of the Plan.
27. During the Commitment Period, the Subscriber is not allowed to:
a. Terminate their XOX MOBILE account or port out to another Mobile Service Provider;
b. Suspend their XOX MOBILE account;
c. Stop payment of monthly bills resulting in the termination of their XOX MOBILE account;
d. Change to other BLACK Plans or Prepaid Plans; and/or
e. Change or transfer ownership of the Plan and Service(s) to another person.
28. Should any of the events in Clause 27 occur, the Subscriber is subject to a Termination Fee including all outstanding amounts due up to the time of early termination.
29. XOX MOBILE reserves the right to impose the Termination Fee on the Subscriber who will bear the responsibility to pay, in the event the Plan is terminated for whatsoever reason before the expiry of the Commitment Period.
30. The Final Settlement Amount would be inclusive of the Termination Fee of RM300, Current Charges, and any Outstanding Amount Due as set out below:
= Amount Due + Current Charge + [(Plan Type x N month(s)) + 6% SST] + RM300 (Termination Fee)
*N = Number of months left in the contract
31. The Subscriber acknowledge and agrees that XOX MOBILE reserve the rights to block the IMEI of the Device and lock Device if the Subscriber:
a. Is suspected of fraud or found to have committed fraud;
b. Reported to XOX MOBILE that the Device is missing or has been stolen and requested for XOX MOBILE to block the IMEI of the Device; and/or
c. Failed to make full payment of any outstanding amount due to XOX MOBILE within THIRTY (30) days of the statement due date.
32. The Subscriber is responsible for any loss, theft, or damage to the Device at all times and shall continue to pay all Charges relevant to the Plan for the Commitment Period, notwithstanding that the Device is lost or damaged.
BILL PAYMENT
33. The Subscriber agrees and undertakes to pay promptly all usage charges due and payable for all Services registered under the Subscriber’s account number irrespective of whether or not such services have been used or partly used or misused by any third party or an unauthorised person by the Subscriber. The Subscriber further agrees and undertakes that in the event of sums due and unpaid, XOX MOBILE reserves the right to withhold or forfeit the balance amounts (if any) or rewards or bonus points from the Subscriber’s account or barred, suspend, restrict, disconnect, impose reconnection fee and/or terminate BLACK Services(s).
34. The Subscriber acknowledges that if any charges remain unpaid under the Subscriber’s account, XOX has the right to charge to the Subscriber’s credit card for such amount outstanding for any XOX Products or Services.
35. Subscribers will need to make payment to maintain an Active account to prevent their BLACK account from being Barred.
36. The bill is subject to six per cent (6%) service tax under the Service Tax Act 2018 (SST) or any other tax imposed by government, of which will be calculated into the monthly bill at the end of the Subscriber’s billing cycle.
37. For bill disputes enquiry, Subscribers may contact XOX Call Centre for clarification.
TERMINATION
38. The Subscriber may terminate the subscription without an early termination charge once the commitment period has been fulfilled.
39. The Subscriber will still be subject to a Termination Fee of RM300 upon requesting for termination or port-out. The Final Settlement Amount would be inclusive of the Termination Fee, Current Charges, and any Outstanding Amount Due as set out below:

40. The Subscriber may terminate the subscription by contacting XOX’s careline or by completing the termination form and forwarding the same to XOX MOBILE within seven (7) working days before the Subscriber’s next billing cycle. Termination form may be sent to XOX via email to enquiries@xox.com.my or at any authorised XOX MOBILE centres.
Beginning 1st January 2020, in the event BLACK Subscribers fail to clear their outstanding payment, XOX MOBILE reserves the right to share their information with Credit Rating Agencies, at any time without referring to the Subscriber. This may affect the Subscriber’s credit standing and eligibility in obtaining financial products moving forward.
41. XOX MOBILE bears no responsibility for replacing the Subscriber’s Device or any part thereof that is lost, stolen, damaged, or defective. The Subscriber is responsible for the repair and maintenance of the Device. Should there be a defect or fault that falls within the extents of the manufacturer’s warranty, then the repairs shall be subject to the applicable warranty as issued by the device manufacturer.
42. The Subscriber acknowledges and agrees that the Device is subject to the device manufacturer’s standard warranty and XOX MOBILE shall not be responsible and/or liable for any Device purchased from us and/or for any loss and/or damage whatsoever suffered by you and/or any other party.
NOTICE
43. The XOX Phone Bundling Plans cannot be exchanged for cash and the Device is not returnable upon acceptance of the contract.
OTHER TERMS & CONDITIONS
44. The above Terms and Conditions will be governed by the laws of Malaysia and the parties agree to submit to the exclusive jurisdiction of Malaysian courts.
45. XOX MOBILE is entitled to make any alternation or changes to the Services in whole or any part thereof, or withdraw or suspend, disconnect, or terminate the Service and will not be liable to the Subscriber or any third party for any loss.
46. XOX MOBILE may at our discretion with prior notice vary the amount of deposit, fees and any Charges for the Services or part thereof and to change the billing cycle.
47. XOX MOBILE reserves the right to change, amend, modify, suspend, continue, terminate & add all or any Terms and Conditions at any time without prior notice. The Terms and Conditions stated herein shall continue to apply subject to any changes, amendments, modifications, suspensions, continuations, variations, modifications, terminations and/or additions contained in this document and shall be read and construed to be enforceable as if such changes, amendments, modifications, suspensions, continuations, variations, modifications, terminations and/or additions were inserted in the document. Continued use of the Service following any amendment or changes to the terms constitutes an acceptance to those changes.
