Terms & Conditions for the usage of XOX MOBILE operator services and products

The Plan: The Bos Gaurus (TBG) Prepaid Plan
You: The Subscriber signing up for the Plan.
GENERAL
1. The Plan and its Services (collectively, “the Plan”) is made available to you subject to your acceptance of these specific Terms and Conditions (“Terms and Conditions”) and any applicable terms and conditions, rules, policies as may be made available by XOX COM SDN BHD (Registration No. 200501027788 (709922-X)) (“XOX”), and all other applicable regulations and law that may or may not be communicated from time to time.
2. The Plan is subject to these Terms and Conditions and to be read together with BLACK Plan (General), XOX's Fair Usage Policy, and any other applicable policies governing the Subscriber’s use of the Plan available at https://onexox.my/
3. Please read the following Terms & Conditions governing the Plan carefully before subscribing and using the Plan.
4. In the event of any conflict or inconsistency between these Terms and Conditions and the BLACK Plan (General), these Terms and Conditions shall prevail.
5. Capitalised terms herein have the same meaning as defined in the General Terms & Conditions.
6. XOX reserve the rights without liability, and from time to time, to modify, amend or change Terms & Conditions (“Variation”), in whole or in part as it deems appropriate and at its sole and absolute discretion. In such instance, wherever reasonably practicable, XOX will give Subscribers reasonable advance notice of such Variation and your continued use of the Plan after the effective date of such Variation shall be bound by such modified Terms and Conditions. 7. XOX reserves the right without liability to amend the terms of the Plan at any time, including but not limited to changes in pricing and Plan features.
ELIGIBILITY
8. On your application to us for the Plan, you agree and consent for us to verify your information in order to determine, at our discretion if the Service may be made available to you. In the event the Services cannot be supplied, your application (including your personal details) will be kept in our records pending availability of the same. Please refer to our XOX Privacy Statement for more information. Notwithstanding, we reserve the right to change the eligibility criteria at any time and from time to time.
9. The Plan is available for all new XOX Subscribers via new registration or Mobile Number Portability (MNP).
10. You confirm that you are above the minimum age of twelve (12) years, and have read, understood, and accepted the Terms and Conditions stated herein.
11. For non-Malaysians to be eligible, you must possess a valid passport with a remaining validity period of no less than six (6) months at the time of registration.
REGISTRATION
12. One (1) Subscriber can only register up to a maximum of five (5) SIMs under single user National Registration Identity Card (NRIC)/Passport.
13. Malaysian citizen is required to register using a valid NRIC whereas non-Malaysians are required to register using a valid passport.
14. Subscribers may subscribe to the plan through the following channels:
(a) XOX and ONEXOX Authorized Dealers
(b) XOX Physical Outlets (XOX SPACE, X-Force, XCCs, & XPPs)
(c) XOX Online Store
(d) Dealer Affiliate Online Store
STARTER PACK
15. A Starter Pack refers to the packaged kit that includes the SIM Card and activation instructions, as provided by XOX to allow Subscribers to activate and begin using the Services under the Plan.
16. Subscribers are responsible to keep their Account Active to enjoy uninterrupted Service provided by XOX under the Plan. For avoidance of doubt, “Account” refers to the Subscriber’s registered account under the Plan.

18. Subscribers may opt for physical SIM Card or eSIM during the registration for the Plan.
19. The Prepaid and Data Validity are activated upon successful registration for an XOX Prepaid Account.
(a) The Prepaid Validity refers to the period of time which the Account remains Active.
(b) The Data Validity refers to the period of time which the data quota provided in a plan is usable.
20. Subscribers may purchase Validity Packages to ensure that their Account remain Active should they opt out of subscribing to any prepaid data plans.
PLAN RATES
21. The following rates shall apply to the Plan:
TOP-UP
22. A top-up of RM1.00 is equivalent to RM1.00 prepaid credit (Airtime) with ONE (1) day of validity under the Subscriber’s Account. Non-Malaysian Subscribers will be subjected to 6% SST.
23. Subscribers may top-up their Airtime via the following platforms:
(a) BLACK App
(b) XOX Self Care Portal
(c) XOX and ONEXOX Authorized Dealers
(d) XOX Wallet
24. Airtime is used by Subscribers to access the Services under the Plan.
25. Subscribers are required to top-up their Account and maintain an Active status to continue utilizing Internet services, voice calls, and SMS. Failure to do so will result in the SIM Card being Barred. In the event that their Account has been Barred, Subscribers may only receive incoming voice calls and SMS with no access to outgoing voice calls, SMS, or Internet services. To regain access to the Services, Subscribers are required to top-up their Account prior to the SIM Card being Blocked. If a top-up is not completed before the SIM Card is Blocked, the Subscriber's Account will be terminated. All remaining Airtime balance will be forfeited, and the Subscriber’s mobile number will be withdrawn with immediate effect without prior written notice from XOX. In such circumstances, Subscribers will be required to purchase a new Starter Pack to re-access the Plan and/or Services.
PREPAID TOP-UP VOUCHERS
26. The top-up validity of the Talk Time credit is the period of time between the date of top-up and the stipulated validity period stated on the back of Subscribers’ top-up vouchers whereby they are granted access to the Services, i.e. 1 day for RM1.00 top-up vouchers, 7 days for RM7.00 top-up vouchers and 30 days for RM30.00 top-up vouchers. (Note: The validity period of top-up purchased from the alternate top-up channels will be the same as the regular top-up vouchers. Every time Subscribers top-up, their SIM Card will compare the remaining validity period of their existing Talk Time credit with the validity period of their new top-up. The higher of the two validity periods will be effective).
27. The prepaid top-up vouchers which have passed the expiry date imprinted on them will not be usable and/or returnable.
28. The prepaid top-up vouchers are not refundable. Any value that has been topped up is not refundable. XOX will not be liable for any loss or damage due to top-up errors caused by the user of the vouchers.
29. XOX reserves the right to forfeit any remaining Talk Time credit after the expiry of the respective validity periods.
30. Any top-up performed using any of the alternate top-up channels outlined in this website or via any other channel which may be added from time to time will be subjected to their own respective terms and conditions that are not governed by XOX.
XOX STORAGE (COMING SOON)
31. XOX Storage is provided for Subscribers to store data, Talk Time, and SMS.
PREPAID VALIDITY LENGTH & RATES
32. Prepaid Validity refers to the time period during which an Account remains Active.
32. A top-up of RM1.00 is equivalent to ONE (1) day of validity.
34. In the event that the Subscriber’s Account is Barred, Subscriber must top-up a minimum amount of RM5.00 per transaction to reactivate the Account.
35. Airtime transfers between XOX Prepaid Subscribers via the USSD Easy Menu will extend the recipient’s Prepaid Validity upon receiving the Airtime. The Validity Period will correspond to the specified Prepaid Validity rates listed below (Coming Soon).
VALIDITY PACKAGES
36. Validity Packages are offered to XOX Prepaid Subscribers to extend the Prepaid Validity of their Account.
37. Subscribers may purchase Validity Packages offered by XOX as stated below:
38. If Subscribers are subscribed to an active data plan, the purchased Validity Package will be activated as a data add-on and will align with the billing cycle of the current data plan.
39. For Subscribers with no active data plan, the Validity Package purchased will be activated as a new data plan subscription (non-recurring).
40. The Validity Packages do not come with Talk Time or SMS.
41. The Validity Period accumulated from the purchase of Validity Packages is capped at ten (10) years, calculated from the date of activation. XOX reserves the right to revoke any Validity Period that exceeds this ten-year limit.
42. Validity Packages can be purchased using Airtime. Subscribers may top-up their Airtime via the following platforms:
(a) BLACK App
(b) XOX Self Care Portal
(c) XOX and ONEXOX Authorized Dealers
43. Prepaid Subscribers may purchase the Validity Packages via the following platforms:
(a) BLACK App
(b) XOX Self Care Portal
TBG PREPAID DATA PLAN SUBSCRIPTION
44. TBG Prepaid Subscribers can only subscribe to a data plan provided they have sufficient data in their XOX Storage or Airtime in their Account.
45. Whenever TBG Prepaid Subscribers subscribe to any data plans, it will be taken from the XOX Storage first.
46. In the event they do not have enough data in their XOX Storage, XOX will automatically deduct their chosen data plan based on the price from their Airtime in their Account.

49. Subscribers may purchase the data plans via the following platforms:
(a) BLACK App
(b) XOX Self Care Portal
(c) USSD Easy Menu – Dial *150#
AUTO-RENEWAL
50. Auto-renewal is when your data plan automatically renews at the end of your plan's expiry period, giving you a hassle-free experience in XOX.
51. Subscribers can only use the auto-renewal function provided they have sufficient data in their XOX Storage or Airtime in their Account.
52. XOX Subscribers can only use the auto-renewal function provided they have an active weekly or monthly data plan.
53. Auto-renewal function is only applicable for our weekly and monthly data plans.
54. Auto-renewal is NOT applicable for the daily data plan.
55. Auto-renewal function is also not applicable for Data Add-On of 20GB @ High Speed.
56. To stop the auto-renewal function, Subscribers can send “DATA AR OFF” to 23388/22111.
57. To terminate the data plan immediately, Subscribers can send “DATA END” to 23388/22111.
XOX PREPAID DATA ADD-ON & RATES
58. If Prepaid Subscribers run out of data before their data plan is renewed, they will be able to purchase our data add-on as stated in our website.
59. Prepaid Subscribers can only purchase data add-on provided that they have an active weekly or monthly data plan.
60. Data add-on is not applicable for the daily data plan.

62. The validity of the data add-on will follow the validity of the data plan.
63. Subscribers may purchase the data add-on via the following platforms:
(a) BLACK App
(b) XOX Self Care Portal
(c) USSD Easy Menu – Dial *150#
CHANGE OF PLAN (COMING SOON)
64. Prepaid Subscribers may change plan to any of the available prepaid plans offered by XOX including:
(a) The Bos Gaurus (TBG) Prepaid Plan
(b) SISWA Prepaid Plan
65. In the event Subscribers proceed to change plan to other prepaid plans, Subscribers acknowledge and accept the following:
(a) Any unused data, Talk Time, and SMS will not be carried forward to the new plan.
(b) Existing data, Talk Time, and SMS in XOX Storage will also not be carried forward to the new plan.
(c) Prepaid Validity and Airtime are entitled to be carried forward to the new plan.
66. Subscribers may change plan to the available postpaid plans offered by XOX including:
(a) ONEXOX BLACK Plans
(b) MySISWA Plan
(c) Football Club (FC) Plans
67. Subscribers may change plan to the available sharing plans offered by XOX as Principal Line including:
(a) ONEfamily Plan
(b) SISWA PLUS Plan
68. Subscribers who wish to change to postpaid plans or sharing plans must acknowledge and accept the following:
(a) Any unused data, Talk Time, and SMS will not be carried forward to the new plan.
(b) Existing data, Talk Time, and SMS in XOX Storage will also not be carried forward to the new plan.
(c) Prepaid Validity will not be carried forward to the new plan.
(d) Any remaining Airtime will be carried forward to the new plan as Advance Payment.
69. Subscribers may change plan via the following platforms:
(a) BLACK App
(b) XOX Self Care Portal
(c) XOX and ONEXOX Authorized Dealers
FAIR USAGE POLICY
70. Subscribers acknowledge and agree that XOX Fair Usage Policy shall apply to these Terms and Conditions. We may change the Policy from time to time without further notice to you. Please refer to XOX Fair Usage Policy periodically to determine any changes to this Policy. Any changes to this Policy will automatically become effective and will apply to you from the date such changes are posted on the website.
MOBILE DATA USAGE
71. For the avoidance of doubt, below is the calculation that XOX uses to calculate the kilobytes for the data quota:
(a) 1GB = 1,024MB
(b) 1MB = 1,024KB
(c) 1GB = 1,048,576KB
72. XOX does not guarantee or warrant the availability of the data usage, and the Subscribers acknowledge and agree that the data usage is provided on an "as is" basis.
73. To experience 5G speed, Subscribers must use a 5G compatible device and the data service is used in an area with 5G network.
74. Software and applications which are used by Subscribers to send and/or receive, for uploading and/or downloading of files can contain very large amounts of data. These software and applications demand a significantly huge amount of bandwidth which will negatively impact the speed and cause network congestion. As a result, a vast majority of Subscribers will be affected from degradation of the quality of Service, and as such is deemed as excessive usage. Excessive usage can also be caused by spamming, virus activities, spy wares and/or other malwares which may reside in Subscribers’ Devices. These activities may be known or unknown to Subscribers and normally operates in the background of the Devices’ operations. Therefore, Subscribers must take all precautions and rightful actions to ensure that the above activities are controlled and minimised at all times. XOX reserves the right to implement and enforce this Mobile Data Usage Policy at its sole discretion upon an occurrence of such activities.
75. The data volume calculation shall take into consideration of ALL activities carried out by Subscribers including those knowing or unknowingly done under the Service.
76. The responsibilities of proving shall be on Subscribers to ensure that the Devices are free from all viruses, spybots and malwares when using the Service. XOX reserves the right to release any information if it is required to do so by any law, regulatory body, or court of law.
77. Subscribers will not be able to use the data service if their Account is in Barred and Blocked status. Subscribers may only continue to use the Internet Service once they perform a top-up before the end of the Blocked period.
SMS USAGE
78. The Subscribers acknowledge that SMS usage will be blocked upon reaching the given numbers of SMS reloaded.
79. SMS used under XOX Prepaid Plans is solely for domestic usage which is for all networks. This SMS will not be usable to send message(s) to any international number or roaming outside of Malaysia.
FURTHER INFORMATION
80. Notwithstanding the Subscriber's status under the XOX Prepaid Plans (save and except any Validity Packages purchased by Subscriber), XOX reserves the right, at all times, to terminate the Subscriber's subscription to the Plan(s) and its Services if the Subscriber has not made a cumulative top up of at least RM30.00 for a continuous period of one hundred and twenty (120) days. Where plan and its Services is Terminated, XOX may revoke the Subscriber's mobile telephone number(s) with immediate effect and without further notice after a final reminder has been given to the Subscriber.
81. Clause 80 shall not apply to Subscriber(s) whose mobile telephone number(s) are on any active Validity Package offered by XOX and purchased by the Subscriber. For the avoidance of doubt, Clause 80 shall take effect on the expiry date of the Subscriber(s) respective validity package.
82. Upon termination of the Subscriber’s subscription to the Plan(s), any unused balance credit, data, Talk Time, and SMS will be forfeited with no refund to the Subscriber. For this purpose, Clause 80 shall prevail over, if any, all other Terms and Conditions governing use of the XOX Prepaid Plans.
83. XOX reserves the right to modify, suspend, restrict, or discontinue the Plan and/or the Services at any time, as deemed necessary, at its sole discretion. These actions may be taken without prior notice and without liability.
PERSONAL DATA PROTECTION
84. By registering and subscribing to the Plan, you consent to the collection, use, and disclosure of your Personal Data in accordance with the Personal Data Protection Act (2024) of Malaysia (the “PDPA 2024”) (As Amended) and our Privacy Policy. “Personal Data” means name, address or email address, and includes less obvious data such as device-related data, call records, online identifiers, location data, and account activity.
85. Your Personal Data may be used for the purposes of:-
(a) To provide and maintain our Services which you subscribed to;
(b) For pre-contractual enquiry before you subscribe to any of our Services;
(c) To process your transactions and manage your account;
(d) To communicate with you regarding your account, including billing and Service updates;
(e) For compliance with legal obligations;
(f) For marketing purposes, where you have given consent.
86. We may disclose your personal data to:
(a) Third-party service providers engaged to assist us in delivering our services.
(b) Regulatory bodies or authorities as required by law.
(c) Other parties as consented by you.
87. You have the right to access and correct your Personal Data at any point of time, as well as to withdraw consent for the processing of your Personal Data. For any inquiries or requests, please contact our customer service.
88. XOX reserve the right to update the terms herein and/or our Privacy Policy periodically to reflect changes in our business, legal, regulatory requirements, and applicable laws. You shall be responsible to visit our Privacy Policy regularly to stay informed about any modifications.
89. If we choose to use or disclose your personally identifiable information in a manner that significantly differs from what was stated in our Privacy Policy at the time of collection, we will provide you with options regarding the new use or disclosure including giving you the opportunity to opt out.
MISCELLANEOUS
90. This Agreement shall be governed by and construed in accordance with the laws of the Malaysia Government, without reference to conflicts of law rules. If any provision of this Agreement is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions contained herein will remain in full force and effect. The failure by XOX to insist upon or enforce strict performance of any provision of the Agreement shall not be construed as a waiver of any provision or right. This Agreement constitutes the entire agreement between you and XOX with respect to the ‘User Get User - Referral Programme’.
91. All disputes and claims arising out of, or relating to this Agreement, which cannot be settled amicably by negotiation between the parties shall be filed in the proper courts of Kuala Lumpur, to the exclusion of all courts and venues. This Agreement shall be interpreted, construed in accordance with, and governed by Malaysia law.
92. XOX reserves the right to change, amend, modify, suspend, continue, vary, modify terminate, and/or add on to all or any part of the Terms & Conditions at any time without prior notice. The Terms and Conditions stated herein shall continue to apply subject to any changes, amendments, modifications, suspensions, continuations, variations, modifications, terminations and/or additions contained in this document and shall be read and construed to be enforceable as if such changes, amendments, modifications, suspensions, continuations, variations, modifications, terminations and/or additions were inserted in the document.
