Terms & Conditions for the usage of XOX MOBILE operator services and products

TERMS AND CONDITIONS: B88 POSTPAID PLAN COMPLIMENTARY TRAVEL DATA eSIM

INTRODUCTION

1.1.            The following Terms and Conditions (“Terms and Conditions”) shall govern the use of the B88 Postpaid Plan’s complimentary Travel Data eSIM (“Service”), offered by XOX Digital Sdn Bhd (Company No. 200701005355 (763354-U)) (“XOX”) to you, the subscriber of the B88 Postpaid Plan.

 

1.2.            The Service shall be made available only to subscribers of the B88 Postpaid Plan (“Plan”). Upon your successful activation of the B88 Postpaid Plan’s subscription, the complimentary Travel Data eSIM setup details shall be delivered via email to you within forty-eight (48) working hours.

 

1.3.            These Terms and Conditions shall be read together with the General Terms and Conditions at https://onexox.my/tandc/details/black-plan-general, the Plan Specific Terms and Conditions at https://onexox.my/tandc/details/black-plan-specific, XOX's Fair Usage Policy and any other applicable terms and conditions, all available at https://onexox.my/tandc/details.

 

1.4.            The Service is intended for personal, non-commercial use only. XOX reserves the right to, at its sole discretion, suspend, terminate, or throttle data speed if it determines that your usage is excessive, unfair, or in violation of these Terms and Conditions.

 

1.5.            XOX reserves the right, at its sole and absolute discretion, to introduce different complimentary Travel Data eSIM or make amendments to or discontinue any existing complimentary Travel Data eSIM under which we provide the Service(s). Such changes may be subject to additional and variation to the applicable terms and conditions.

 

ELIGIBILITY

2.1              The Service is available only to subscribers of the B88 Postpaid Plan.

2.2              The Service is not available in countries outside the Service’s designated coverage area as stipulated under Clause 3.3 below.

 

2.3              The Service will not be available to you if your account is suspended or has any outstanding bills with XOX.

 

2.4              The Service is provided exclusively via eSIM. You shall be solely responsible for ensuring that your device is eSIM-compatible and supports the use of eSIM prior to subscription or activation of the Service.

 

SERVICE AND COVERAGE

3.1              The Service offers mobile data usage in selected countries, subject to the allocated data quota. XOX shall not be responsible for any additional charges, costs, or expenses incurred during your use of the Service.

 

3.2              The Service is not applicable for voice and Short Message Service (SMS).

 

3.3              The Service coverage shall extend to eighty-eight (88) countries, divided into two (2) zones, as may be specified by XOX from time to time.

 

 

3.4              The maximum total data entitlement under the Service is strictly capped at 18GB per billing cycle (“Data Quota”). Any unused data shall not be carried forward, accumulated, exchanged, or refunded. Once the Data Quota is fully utilised, there will be no further data allocation until the next billing cycle begins. The details are tabled as follows:

 

 

3.5         Zone A: thirteen (13) countries –

3.5.1        The complimentary Travel Data eSIM, delivered via email to you upon successful activation of the B88 Postpaid Plan’s subscription, shall be valid for use only in the countries listed under Zone A. For the avoidance of doubt, the aforementioned eSIM shall hereinafter be referred to as “Zone A eSIM.”

 

3.5.2        The Zone A eSIM must be activated within thirty (30) days from the date of receipt. Failure to activate within this period shall result in the Zone A eSIM’s expiry, and no free replacement shall be provided.

 

3.5.3        The Zone A eSIM is provisioned to and belongs to you. As long as your subscription to the Plan remains active without any outstanding charges, the same eSIM may continue to be used.

 

3.5.4        Once the Zone A eSIM has been installed, you shall not delete, remove and/or disable the eSIM profile from your device.

 

 

3.5.5        In the event that the Zone A eSIM is deleted, removed and/or disabled, you may request for a replacement eSIM, available at https://shop.xox.com.my/travelesim, subject to the prevailing charges stated therein.

 

3.6         Zone B: seventy-five (75) countries –

 

3.6.1        Made available and provided upon your request, this complimentary Travel Data eSIM shall be valid for use in one (1) of the countries listed under Zone B. The aforementioned eSIM shall hereinafter be referred to as “Zone B eSIM.”

 

3.6.2        Subject always to the maximum total data entitlement as stipulated under Clause 3.4, you may request for the Zone B eSIM at least forty-eight (48) working hours before your travel departure via either one of the following channels:

 

(i)      WhatsApp at +6010-3333010; or

(ii)    XOX’s official customer service hotline; or

(iii)   email to support_lifestyle@xox.com.my.

 

3.6.3        The Zone B eSIM setup details shall be delivered via email to you within forty (48) working hours.

 

3.6.4        Where a Zone B eSIM is issued to you upon your request, such Zone B eSIM shall constitute your current active complimentary Travel Data eSIM. For the avoidance of doubt, your Zone A eSIM shall be disabled temporarily from the date of issuance of the Zone B eSIM to you, and the balance (in whole or in part) of your Data Quota and Validity shall be allocated to your Zone B eSIM, capped at daily 1GB high speed.

 

3.6.5        Any additional request for Zone B eSIM shall only be permitted upon the expiry of your Validity or full utilisation of the Data Quota under your initial Zone B eSIM, whichever earlier.

 

3.6.6        Upon the expiry of your Zone B eSIM’s Validity, your Zone A eSIM shall be restored for your use accordingly, subject always to the maximum total data entitlement as stipulated under Clause 3.4.

 

3.6.7        The Zone B eSIM must be activated within seven (7) days from the date of receipt. Failure to activate within this period shall result in the Zone B eSIM’s expiry, and no free replacement shall be provided.

 

3.6.8        Once the Zone B eSIM has been installed, you shall not delete, remove and/or disable the Zone B eSIM profile from your device until the conclusion of your stay in the specific country.

 

3.6.9        In the event that the Zone B eSIM is deleted, removed and/or disabled during your stay in the specific country, you may request for a replacement eSIM, available at https://shop.xox.com.my/travelesim, subject to the prevailing charges stated therein.

 

3.7         At any given time, only one (1) of the Zone A eSIM or Zone B eSIM may be used. The Service does not provide for and strictly prohibits concurrent usage of multiple complimentary Travel Data eSIMs.

 

3.8         XOX reserves the right to review and amend the Daily Quota from time to time in accordance with XOX’s prevailing Fair Usage Policy.

 

3.9         XOX does not guarantee or warrant the availability of the data usage, and you acknowledge and agree that the data usage is provided on an "as is" basis.

 

3.10     Any replacement eSIM issued shall not confer a new entitlement. The replacement eSIM shall only reflect the unexpired Validity and the remaining Data Quota, if any, of the original complimentary Travel Data eSIM.

 

SUSPENSION OR TERMINATION OF SERVICE

       4.1       The Service shall be terminated concurrently, with the termination or expiry of the Plan, for any reason whatsoever.

 

       4.2       In the event your subscription to the Plan is barred, the Service shall likewise be terminated. Should you subsequently reactivate the subscription to the Plan, a replacement eSIM may be requested via https://shop.xox.com.my/travelesim, or by email to support_lifestyle@xox.com.my, subject to the prevailing charges stated therein.

 

       4.3       XOX reserves the right, at its sole discretion, to suspend or terminate the Service at any time in the event of suspected fraud, misuse, abuse, illegal activity, or any breach of these Terms and Conditions or other applicable terms and conditions.

 

       4.4       XOX shall not, under any circumstances, be liable or responsible to you for any damages, losses, refunds, or monetary compensation whatsoever arising from your failure to request a replacement eSIM.

 

PERSONAL DATA

       5.1       By registering and subscribing to the Plan, you consent to the collection, use, and disclosure of your Personal Data in accordance with the Personal Data Protection Act (2010) of Malaysia (the “PDPA 2010”) (As Amended) and our Privacy Notice (as detailed out in   https://xox.com.my/privacyStatement/details/). “Personal Data” means name, address or email address, and includes less obvious data such as device-related data, call records, online identifiers, location data, and account activity.

 

       5.2       Your Personal Data may be used for the purposes of:-

i.          To provide and maintain our Services which you subscribed to;

ii.         For pre-contractual enquiry before you subscribe to any of our Services;

iii.        To process your transactions and manage your account;

iv.        To communicate with you regarding your account, including billing and Service updates;

v.          For compliance with legal obligations;

vi.        For marketing purposes, where you have given consent.

       5.3       We may disclose your personal data to:

i.          Third-party service providers engaged to assist us in delivering our services.

ii.         Regulatory bodies or authorities as required by law.

iii.        Other parties as consented by you.

       5.4       You have the right to access and correct your Personal Data at any point of time, as well as to withdraw consent for the processing of your Personal Data. For any inquiries or requests, please contact our customer service.

 

       5.5       XOX reserve the right to update the terms herein and/or our Privacy Notice periodically to reflect changes in our business, legal, regulatory requirements, and applicable laws. You shall be responsible to visit our Privacy Notice regularly to stay informed about any modifications.

 

       5.6       If we choose to use or disclose your personally identifiable information in a manner that significantly differs from what was stated in our Privacy Notice at the time of collection, we will provide you with options regarding the new use or disclosure including giving you the opportunity to opt out.

 

DATA SHARING CONSENT

6.1     By opting into such Promotions, you expressly consent to the sharing of your personal data (limited to name, identity no., mobile number, and subscription status) with the relevant Third Party for the purposes of:

(i)      Eligibility verification;

(ii)    Offer fulfilment;

(iii)   Campaign performance tracking; and

(iv)   Reporting to CTOS Data Systems Sdn Bhd (Company No.: 199001009139 (209029-W)) (“CTOS”) or other licensed credit reporting agencies for:

·      Conducting credit checks and trade reference assessments to evaluate your creditworthiness for the Plan;

·      Updating and maintaining credit information related to your account;

·      Reporting any payment defaults, fraud, or breaches which may result in your account being flagged on CTOS’s credit blacklist.

in accordance with XOX’s Privacy Notice and the Personal Data Protection Act 2010.

GENERAL

7.1     By your use of the Service, you are deemed to have read, understood, and agreed to be bound by these Terms and Conditions and agree that any and all decisions made by XOX in relation to every aspect of the Service shall be final, binding and conclusive.

 

7.2     Any breach of these Terms and Conditions may, at XOX’s absolute discretion, result in forfeiture of any of the goods or services rendered. XOX shall not be liable for any claim whatsoever resulting from your use of the Service.

7.3     XOX does not warrant that the Service shall be uninterruptible and/or error free. By using the Service, you hereby acknowledge and irrevocably agree that XOX shall not in any manner whatsoever be liable for any technical failures of any kind, system/server interruption and/or any electronic error arising from the Service unless the same arise from and are caused directly by XOX’s gross negligence and wilful default.

 

7.4     XOX is not liable for any default in respect of the Service due to any circumstances beyond XOX’s control including but not limited to acts of God, acts or omissions of government or other authorities, new or amending Laws and regulations effective after the date of this Agreement, acts of terrorisms/sabotage, fires, explosions, lockouts, restrictive movements, riots, strikes, embargoes, act of war, epidemics, pandemics, inclement weather, earthquakes and other natural disasters.

 

7.5     XOX reserves the right to alter, change, extend, suspend, or terminate the Service, the Service period, or amend, modify these terms and conditions stated herein at its sole discretion any time without prior notice. XOX will endeavour to provide thirty (30) days’ notice of any changes but may not be able to do so in all circumstance. In case of any disputes arising directly or indirectly from the Service, the decision of XOX shall be final.

 

7.6     XOX, its related and associated companies, and its agencies and companies associated with the Service disclaim all warranties, express or implied, including but not limited to any implied warranties of merchantability or fitness for a particular purpose. XOX shall not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death, which is suffered or sustained (Whether or not arising from any person’s negligence) resulting from their use of the Service, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). You undertake that you shall not bring any claims or actions against XOX or its related and associated companies, whether in contract, tort or otherwise.

 

7.7     By your use of the Service, you irrevocably agree to release and hold harmless XOX and its associate companies, employees, advisors for any and all losses, damages, rights, claims and actions of any kind in connection with the Service, including without limitation, personal injury, death, and property damage.

 

7.8     Failure by XOX to insist upon or enforce strict performance of any of these Terms and Conditions shall not be construed as a waiver of any provision or right.

 

 

7.9     These Terms and Conditions are governed by the laws of Malaysia. You agree that the Courts of Malaysia have exclusive jurisdiction over all matters arising from this Service.
